Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Analytify.ai (“Service”), a platform owned and operated by StratApps Inc. (“Company”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and warrant that you have the authority to bind that organization.
“Customer” or “you”: The individual or entity that creates an account or uses the Service.
“Customer Data”: Data provided by or on behalf of Customer via the Service.
“Documentation”: User guides, technical documentation, and help content made available by us.
“Order Form”: Any agreement or registration document that sets forth the pricing and usage limits for the Service.
“Service”: The hosted platform, APIs, software tools, and components provided by Analytify.ai.
You must be at least 18 years old and legally capable of entering into a binding agreement.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms.
You shall not:
• Reverse engineer or attempt to extract the source code of the Service;
• Use the Service to infringe the intellectual property or other rights of third parties;
• Use the Service to transmit malicious code or content;
• Circumvent or attempt to circumvent usage limits specified in the Order Form.
You are solely responsible for:
• Your Customer Data, including its accuracy, quality, legality, and non-infringement;
• Maintaining the confidentiality of your account credentials;
• Ensuring your use complies with applicable laws and regulations.
We process Customer Data only to provide the Service and in accordance with our Privacy Policy. You retain all ownership rights in your Customer Data. We implement industry-standard safeguards to protect your data.
For customers subject to data protection laws such as GDPR or CCPA, a Data Processing Agreement (DPA) may be executed upon request.
All rights, title, and interest in and to the Service, including all related intellectual property rights, remain the exclusive property of StratApps Inc. and its licensors.
No rights are granted to you other than those explicitly stated in these Terms.
You agree to pay all fees specified in the applicable Order Form. Fees are non-refundable unless otherwise stated. Late payments may result in suspension or termination of access.
Usage-based pricing and overage fees (if applicable) will be calculated in accordance with our Pricing Policy.
These Terms are effective as of the date you accept them and remain in effect until terminated.
You may stop using the Service at any time. If you terminate before the end of a subscription term, no refund will be provided.
We may suspend or terminate your access for:
• Violation of these Terms;
• Non-payment;
• Required by law or court order.
Upon termination, your access to the Service will cease, and we will delete or return your Customer Data as required by applicable law.
Each party agrees to protect the other party’s confidential information with reasonable care and not disclose it to any third party, except as required by law or as necessary to perform under these Terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRATAPPS INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless StratApps Inc., its affiliates, and personnel from any claims, liabilities, damages, and expenses arising from:
• Your use of the Service;
• Your violation of these Terms;
• Your Customer Data.
We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in San Francisco County, CA, in accordance with the rules of the American Arbitration Association.
• Entire Agreement: These Terms constitute the entire agreement between you and StratApps Inc.
• Waiver and Severability: If any provision is found unenforceable, the remainder will remain in effect.
• Force Majeure: We are not liable for failures due to events beyond our control.
